Terms of Service

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your own non-commercial creative use, in accordance with these Terms.

The App is licensed, not sold. Distribution via the Apple App Store (or other platforms) is also governed by that platform's standard terms; these Terms do not override them.

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement and have the legal capacity to agree to these Terms.

You retain all ownership rights in the photos and other content you import, create, or export using the App (“Your Content”).

You represent that you have all necessary rights to any photos you import, and that your use of the App — including the output you create — does not infringe the rights of any third party, including copyright, trademark, privacy, or publicity rights.

You are solely responsible for Your Content and for any consequences of sharing it outside the App.

You agree not to:

• Use the App to create, store, or distribute unlawful, infringing, defamatory, or harmful content;
• Reverse engineer, decompile, or disassemble the App, or attempt to extract its source code (except to the extent applicable law prohibits this restriction);
• Circumvent any technical limitations, licensing, or digital rights management;
• Use the App in any manner that could damage, disable, overload, or impair the App or interfere with any other party's use;
• Use the App for any commercial service or to train automated models without our prior written consent.

The App includes filters, templates, stamps, fonts, and other creative assets (collectively, “Materials”). The Materials are licensed to you for use inside the App to create Your Content.

• You may sell or publish Your Content that you create using the Materials.
• You may not extract, redistribute, resell, or sublicense the Materials as standalone assets, or include them in a competing product.
• Some Materials may incorporate third-party fonts or artwork; rights in those components are subject to their own licenses.

The App provides free core features and offers optional paid access to premium features (“HuePhoto Premium”), available via auto-renewable subscriptions (e.g., monthly or yearly plans) or one-time purchases (e.g., lifetime access).

Subscription Benefits: Active subscribers receive unlimited access to premium templates, exclusive filters, design assets, and all upcoming subscriber-only features during the subscription term.

Payment and Billing: All purchases and subscriptions are processed through the Apple App Store. Payment will be charged to your Apple ID account upon confirmation of purchase. Prices are clearly displayed within the App before purchase.

Auto-Renewal: Subscriptions automatically renew unless auto-renew is disabled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

Managing and Canceling Subscriptions: You can manage and cancel your subscriptions at any time. After purchase, you can turn off auto-renewal by going to your iOS device Settings > [Your Apple ID] > Subscriptions, and selecting HuePhoto. If you cancel, your premium benefits remain active until the end of the current billing cycle.

Free Trial: If a free trial is offered, details will be specified prior to purchase. Unless canceled at least 24 hours before the trial ends, it will automatically convert into a paid auto-renewable subscription. Any unused portion of a free trial period will be forfeited when you purchase a subscription, where applicable.

Refunds and Price Changes: All transactions and refund requests are governed by Apple Media Services Terms and Conditions. To request a refund, please contact Apple directly via reportaproblem.apple.com. We reserve the right to adjust subscription pricing with advance notice; price changes will take effect at the start of the subsequent subscription period.

Except for Your Content and the limited license above, we (or our licensors) retain all rights, title, and interest in and to the App — including software, design, trademarks, trade names, and the Materials.

The App is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express, implied, or statutory. We do not warrant that the App will be uninterrupted, error-free, secure, or compatible with future device OS versions.

Your photos are stored locally on your device. You are solely responsible for backing up Your Content. We are not liable for data loss caused by device failure, OS updates, accidental deletion, or uninstallation.

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to the App or these Terms.

Our total aggregate liability for any claim arising from these Terms or your use of the App shall not exceed the greater of (a) the amounts you have paid us in the twelve (12) months preceding the claim, or (b) [USD $50 / Applicable Statutory Minimum].

Some jurisdictions do not allow certain liability limitations; the foregoing shall apply to the fullest extent permitted in your jurisdiction.

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from Your Content or your breach of these Terms.

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access at any time, for any reason, including violation of these Terms. Upon termination, your license ends, but the sections concerning ownership, disclaimers, limitation of liability, and indemnification survive.

We may modify these Terms from time to time. The “Last updated” date reflects the current version. Continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using the App.

These Terms are governed by the laws of [JURISDICTION / Applicable Legal Jurisdiction], without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the courts located in [JURISDICTION / Applicable Legal Jurisdiction] — except where mandatory local consumer law gives you a right to a different forum.
